Willkommen im Herzen des DYVE-Ökosystems. Diese Nutzungsbedingungen regeln deinen Zugriff auf die DYVE-Plattform, die darauf ausgelegt ist, Kultur zu fördern und persönliche Begegnungen (In Real Life - IRL) zu erleichtern. Durch die Nutzung unserer Dienste erklärst du dich damit einverstanden, die Dynamik und Integrität der Community zu respektieren.

Welcome to the core of the DYVE ecosystem. These Terms of Use govern your access to the DYVE platform, designed to drive culture and facilitate In Real Life (IRL) connections. By using our services, you agree to respect the momentum and integrity of the community.

2. Leistungsbeschreibung2. Service Description

DYVE ist ein soziales Mapping- und Event-Entdeckungsnetzwerk. Wir stellen die digitale Infrastruktur bereit, damit Nutzer Gruppen bilden, lokale Treffen organisieren und kulturelle Anlaufpunkte (Locations, Artists, kuratierte Events) entdecken können. DYVE ist nicht für die Durchführung von IRL-Events Dritter verantwortlich.

DYVE is a social mapping and event discovery network. We provide the digital infrastructure for users to form groups, organize local hangouts, and discover cultural touch points (venues, artists, curated events). DYVE is not responsible for the execution of third-party IRL events.

3. Community-Standards & Zulässige Nutzung3. Community Standards & Acceptable Use

DYVE existiert, um IRL-Erlebnisse aufzuwerten. Als Mitglied dieses Ökosystems hat dein Verhalten direkten Einfluss auf den gemeinsamen "Vibe".

DYVE exists to elevate IRL experiences. As a member of this ecosystem, your behavior directly impacts the collective "Vibe".

• Authentizität: Du darfst dich nicht als andere Personen ausgeben oder täuschende Identitäten erstellen.
• Respekt: Belästigung, Hassrede und bedrohliches Verhalten, entweder in der App oder bei über unsere Plattform organisierten IRL-Events, führen zur sofortigen Kündigung deines Kontos.
• Kein Scraping/Manipulation: Der Versuch, Momentum-Scores künstlich aufzublähen, Nutzerdaten zu scrapen oder die Plattform-Infrastruktur zu überlasten, ist strengstens untersagt.

• Authenticity: You must not impersonate others or create deceptive entities.
• Respect: Harassment, hate speech, and threatening behavior, either in-app or at IRL events organized through our platform, will result in immediate termination of your account.
• No Scrape/Manipulation: Attempting to artificially inflate momentum scores, scrape user data, or overload the platform infrastructure is strictly prohibited.

4. Von Nutzern organisierte IRL-Erlebnisse4. User-Organized IRL Experiences

Als "Culture Driver" kannst du DYVE nutzen, um Events zu organisieren. Du bist allein dafür verantwortlich, dass deine Events allen lokalen Gesetzen, Genehmigungen und Sicherheitsvorschriften entsprechen. DYVE übernimmt keine Haftung für Vorfälle, die bei über unsere Plattform initiierten Erlebnissen auftreten.

As a "Culture Driver," you may use DYVE to organize events. You are solely responsible for ensuring your events comply with all local laws, permits, and safety regulations. DYVE assumes no liability for incidents occurring at experiences formed using our platform.

5. Geistiges Eigentum5. Intellectual Property

Alle Marken, Code und das strukturelle Design innerhalb der Anwendung sind das geistige Eigentum von DYVE und dessen Schöpfer. Alle von dir hochgeladenen nutzergenerierten Inhalte (Bilder, Bewertungen, Event-Details) bleiben dein Eigentum. Durch das Hosting auf DYVE gewährst du uns jedoch eine Lizenz zur Anzeige, Verbreitung und Nutzung im Rahmen des Betriebs des Dienstes, einschließlich der Nutzung und Anzeige hochgeladener Bilder/Medien in der mobilen Anwendung.

All branding, code, and structural design within the application is the intellectual property of DYVE and its creator. Any user-generated content (images, reviews, event details) uploaded by you remains your property, but by hosting it on DYVE, you grant us a license to display, distribute, and utilize it within the context of operating the service, including the use and display of uploaded images/media within the mobile application.

6. Serviceverfügbarkeit6. Service Availability

Technologie ist von Natur aus dynamisch. Wir verschieben kontinuierlich ästhetische Grenzen und entwickeln Features weiter, was bedeutet, dass sich die App schnell ändern kann. Wir garantieren keine ununterbrochene, fehlerfreie Verfügbarkeit unserer Server zu jeder Zeit.

The nature of tech is dynamic. We continually push aesthetic boundaries and feature updates which means the app may alter rapidly. We do not guarantee uninterrupted, bug-free availability of our servers at all times.

7. Haftungsbeschränkung7. Limitation of Liability

Soweit gesetzlich zulässig, haftet David Bläsing (DYVE) nicht für indirekte, zufällige oder Folgeschäden, die sich aus deiner Nutzung der Plattform, deiner Teilnahme an IRL-Events oder dem Verhalten Dritter ergeben.

To the maximum extent permitted by law, David Bläsing (DYVE) shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the platform, your attendance at IRL events, or the conduct of third parties.
